Texas is a community property state. Assets and debts acquired during the marriage are generally divided between spouses upon divorce — but "divided" doesn't always mean "50/50." Courts look at factors including each spouse's earning capacity, education, fault in the breakup of the marriage, and the needs of the children. Whether your case is amicable or contested, we work to protect what you brought into the marriage and to secure your fair share of what was built during it.
Child Custody & Conservatorship
Texas courts use the term conservatorship rather than custody. Most cases result in Joint Managing Conservatorship, where both parents share decision-making rights, but one parent is designated to determine the child's primary residence. In cases involving family violence, substance abuse, or significant instability, Sole Managing Conservatorship may be appropriate. We build custody cases around the standards courts actually apply — the Holley factors — and the day-to-day reality of your child's life.
Child Support & Spousal Maintenance
Texas child support is calculated under statutory guidelines based on the obligor's net resources, with caps and adjustments for multiple children, healthcare, and special circumstances. Spousal maintenance — what many people call "alimony" — is more limited in Texas than in other states and generally requires a marriage of at least ten years or other specific qualifying circumstances. We make sure the numbers, the calculations, and the orders reflect the full picture.
Modifications & Enforcement
Life changes after a divorce. Jobs change, parents move, children's needs evolve. When circumstances shift materially, custody, support, and visitation orders can be modified. When the other party isn't following the orders, they can be enforced — with contempt remedies that include fines and even jail. We handle both sides.
Protective Orders
If you or your children are in danger from a family member or partner, a protective order can provide immediate legal protection. We help victims of family violence file for emergency and final protective orders, and we represent the wrongly accused when allegations are being used as leverage in another proceeding.
